Spr\u00e1va poukazuje jednak na nedostatky v\u00a0aktu\u00e1lnom legislat\u00edvnom procese a v \u010dinnosti \u00daradu pre ochranu osobn\u00fdch \u00fadajov, no z\u00e1rove\u0148 vyzdvihuje, na z\u00e1klade konkr\u00e9tnych rozhodnut\u00ed v\u00a0tejto oblasti, rozhodovaciu prax slovensk\u00fdch s\u00fadov.\u00a0<\/i><\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Zverejnen\u00e1 Spr\u00e1va o\u00a0ochrane osobn\u00fdch \u00fadajov za rok 2020 je jedine\u010dn\u00fd sum\u00e1r v\u00a0slovensk\u00fdch re\u00e1li\u00e1ch, ke\u010f\u017ee v\u00a0oblasti ochrany osobn\u00fdch \u00fadajov boli doteraz dostupn\u00e9 len v\u00fdro\u010dn\u00e9 spr\u00e1vy \u00daradu pre ochranu osobn\u00fdch \u00fadajov SR (\u201e\u00darad\u201c). Tie sa ale zameriavali sk\u00f4r na \u0161tatistiky o\u00a0\u010dinnosti samotn\u00e9ho \u00daradu a\u00a0nevenovali sa dostato\u010dne problematike samotnej. Komplexn\u00fd dokument, ktor\u00fd pripravili advok\u00e1ti z\u00a0DAGITAL Legal mapuje relevantn\u00e9 legislat\u00edvne udalosti, \u010dinnos\u0165 a\u00a0pokuty ulo\u017een\u00e9 \u00daradom a rozhodnutia s\u00fadov v\u00a0sk\u00famanej oblasti, ktor\u00e9 doteraz neboli verejne dostupn\u00e9.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Legislat\u00edvne udalosti ovplyvnila pand\u00e9mia<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Pand\u00e9mia a\u00a0jej d\u00f4sledky priniesli ve\u013ek\u00fd verejn\u00fd a\u00a0medi\u00e1lny tlak na kvalitu pr\u00e1vnych predpisov aj vo vz\u0165ahu k\u00a0ochrane osobn\u00fdch \u00fadajov a\u00a0s\u00fakromia. V\u00a0priebehu roka 2020 bol na z\u00e1klade uznesenia \u00dastavn\u00e9ho s\u00fadu SR z\u00fa\u017een\u00fd rozsah \u00fadajov, ktor\u00e9 telekomunika\u010dn\u00ed oper\u00e1tori poskytovali \u00daradu verejn\u00e9ho zdravotn\u00edctva SR, viackr\u00e1t bol novelizovan\u00fd Z\u00e1kon o\u00a0ochrane verejn\u00e9ho zdravia (napr\u00edklad kv\u00f4li vyu\u017e\u00edvaniu aplik\u00e1ci\u00ed na sledovanie dodr\u017eiavania karant\u00e9ny) a\u00a0prezidentka odmietla podp\u00edsa\u0165 novelu z\u00e1kona o\u00a0elektronick\u00fdch komunik\u00e1ci\u00e1ch. T\u00e9mou t\u00fdchto udalost\u00ed bola aj ochrana s\u00fakromia a\u00a0osobn\u00fdch \u00fadajov. <\/span><i><span style=\"font-weight: 400;\">\u201ePri ka\u017edom strete GDPR, z\u00e1kona o\u00a0ochrane verejn\u00e9ho zdravia a\u00a0z\u00e1kona o\u00a0elektronick\u00fdch komunik\u00e1ci\u00e1ch bolo v\u00a0roku 2020 viac ako kedyko\u013evek predt\u00fdm c\u00edti\u0165 <\/span><\/i><b><i>absenciu nez\u00e1visl\u00e9ho org\u00e1nu<\/i><\/b><i><span style=\"font-weight: 400;\">, ktor\u00fd by dok\u00e1zal poskytn\u00fa\u0165 metodick\u00fa a\u00a0analytick\u00fa podporu pre zodpovedn\u00e9 osoby \u0161t\u00e1tu. T\u00e1to <\/span><\/i><b><i>agenda je rie\u0161en\u00e1 ad hoc, neriadene a\u00a0bez rozpo\u010dtu<\/i><\/b><i><span style=\"font-weight: 400;\">, \u010do, ostatne potvrdil aj NK\u00da vo svojej spr\u00e1ve. Aj na \u00farovni E\u00da m\u00e1me dva samostatn\u00e9 org\u00e1ny \u2013 v\u00fdbor a\u00a0dozorn\u00e9ho \u00faradn\u00edka,\u201c <\/span><\/i><span style=\"font-weight: 400;\">upozor\u0148uje odborn\u00edk na ochranu osobn\u00fdch \u00fadajov Jakub Berthoty<\/span><i><span style=\"font-weight: 400;\">. \u201e<\/span><\/i><b><i>Z\u00e1kladn\u00e9 ot\u00e1zky<\/i><\/b><i><span style=\"font-weight: 400;\"> t\u00fdkaj\u00face charakteru a fungovania pr\u00e1vnych z\u00e1kladov z\u00e1konnej povinnosti, verejn\u00e9ho a opr\u00e1vnen\u00e9ho z\u00e1ujmu <\/span><\/i><b><i>mali by\u0165 pritom v\u00a0na\u0161om pr\u00e1vnom poriadku d\u00e1vno vyjasnen\u00e9, no evidentne nie s\u00fa a absencia niekoho, ako je dozorn\u00fd \u00faradn\u00edk sp\u00f4sobuje v\u00a0kombin\u00e1cii s aktu\u00e1lnym pr\u00edstupom \u00daradu probl\u00e9my<\/i><\/b><i><span style=\"font-weight: 400;\">,\u201c <\/span><\/i><span style=\"font-weight: 400;\">zd\u00f4raz\u0148uje Jakub Berthoty.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Zaost\u00e1vame za eur\u00f3pskymi \u0161tandardmi<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Ve\u013ek\u00e1 \u010das\u0165 verejn\u00fdch a\u00a0medi\u00e1lnych vyjadren\u00ed \u00daradu sa v\u00a0roku 2020 venovala t\u00e9mam spojen\u00fdm s\u00a0pand\u00e9miou. \u00darad sa vyjadroval k\u00a0projektu inteligentnej karant\u00e9ny, aplik\u00e1ci\u00e1m, \u010di celo\u0161t\u00e1tnemu testovaniu. Niektor\u00e9 stanovisk\u00e1 \u00daradu s\u00favisiace s\u00a0plo\u0161n\u00fdm testovan\u00edm pritom pova\u017euje odborn\u00e1 verejnos\u0165 za problematick\u00e9 a\u00a0vysl\u00fa\u017eili si vlnu kritiky. Spr\u00e1va \u00daradu pre ochranu osobn\u00fdch \u00fadajov vy\u010d\u00edta aj nieko\u013eko \u010fal\u0161\u00edch pochyben\u00ed: <\/span><i><span style=\"font-weight: 400;\">\u201eHodnoti\u0165 pozit\u00edvne \u010dinnos\u0165 n\u00e1\u0161ho regul\u00e1tora, celkov\u00e9 riadenie tejto oblasti z poh\u013eadu \u0161t\u00e1tu a z poh\u013eadu legislat\u00edvneho procesu by bolo klamanie seba sam\u00e9ho. Existuj\u00fa s\u00edce \u010dlensk\u00e9 \u0161t\u00e1ty ako Est\u00f3nsko, kde dodnes neexistuje ani jedin\u00e1 pokuta udelen\u00e1 pod\u013ea GDPR. Ak sa v\u0161ak pozrieme na z\u00e1padn\u00e9 eur\u00f3pske krajiny, zist\u00edme, \u017ee <\/span><\/i><b><i>Slovensko s\u00edce vykazuje ur\u010dit\u00fa administrat\u00edvnu \u010dinnos\u0165, ale v skuto\u010dnosti sme na \u00faplnom za\u010diatku v budovan\u00ed tejto oblasti.<\/i><\/b><i><span style=\"font-weight: 400;\">&quot;<\/span><\/i><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">V zahrani\u010d\u00ed boli t\u00e9mou roka cezhrani\u010dn\u00e9 prenosy do USA a Spojen\u00e9ho kr\u00e1\u013eovstva, v d\u00f4sledku zru\u0161enia EU-US Privacy Shield a Brexitu. Zahrani\u010dn\u00e9 dozorn\u00e9 org\u00e1ny sa venovali pos\u00fadeniu pou\u017e\u00edvania produktov ako Microsoft 365 Office, Google Analytics, cieleniu reklamy cez soci\u00e1lne siete a sprac\u00favaniu cookies v kontexte pripravovan\u00e9ho nov\u00e9ho ePrivacy nariadenia. <\/span><b>Tieto n\u00e1stroje pou\u017e\u00edvaj\u00fa takmer v\u0161etci prev\u00e1dzkovatelia aj na Slovensku a citlivos\u0165 t\u00fdchto spracovate\u013esk\u00fdch oper\u00e1cii je neporovnate\u013en\u00e1 s agendou COVID-19, kamerov\u00fdmi syst\u00e9mami, rodn\u00fdmi \u010d\u00edslami, zverej\u0148ovan\u00edm zml\u00fav a podobn\u00fdmi t\u00e9mami, ktor\u00fdm sa u\u017e tradi\u010dne venuje n\u00e1\u0161 \u00darad.<\/b><span style=\"font-weight: 400;\"> Ide v\u0161ak o nepochybne komplexnej\u0161ie t\u00e9my, ktor\u00e9 vy\u017eaduj\u00fa ove\u013ea n\u00e1ro\u010dnej\u0161\u00ed v\u00fdklad, ku ktor\u00e9mu sa prax \u00daradu e\u0161te nedostala.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Nedostatky v\u00a0\u010dinnosti regul\u00e1tora<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Spr\u00e1va tie\u017e kritizuje \u00darad za to, \u017ee od m\u00e1ja 2018 neprijal vyhl\u00e1\u0161ky, s\u00a0ktor\u00fdmi po\u010d\u00edta z\u00e1kon o\u00a0ochrane osobn\u00fdch \u00fadajov od 25. m\u00e1ja 2018. <\/span><i><span style=\"font-weight: 400;\">\u201e\u00darad u\u017e viac ako dva a\u00a0pol roka \u010dak\u00e1 na nap\u00edsanie listu V\u00fdboru, v\u00a0ktorom by si nechal potvrdi\u0165 akredita\u010dn\u00e9 a\u00a0certifika\u010dn\u00e9 krit\u00e9ria. Pritom n\u00e1vrh t\u00fdchto krit\u00e9ri\u00ed, ako aj samotn\u00fa vyhl\u00e1\u0161ku sme \u00daradu pripravili. Viacer\u00e9 sektory, vr\u00e1tane advok\u00e1tov, b\u00e1nk a\u00a0pois\u0165ovn\u00ed, maj\u00fa k\u00f3dexy spr\u00e1vania, ale nem\u00f4\u017eu prist\u00fapi\u0165 k\u00a0ich uplat\u0148ovaniu v\u00a0praxi. Tieto k\u00f3dexy s\u00fa pritom prospe\u0161n\u00e9 pre v\u0161etk\u00fdch, ke\u010f\u017ee \u010dastokr\u00e1t napr\u00e1vaj\u00fa v\u00fdkladov\u00e9 medzery a nezrovnalosti v\u00a0pr\u00e1vnych predpisoch.\u201c <\/span><\/i><span style=\"font-weight: 400;\">dod\u00e1va k\u00a0spr\u00e1ve advok\u00e1t Jakub Berthoty z\u00a0DAGITAL Legal.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Alarmuj\u00faca je pod\u013ea spr\u00e1vy aj neexistencia tzv. legislat\u00edvneho pos\u00fadenia vplyvu na ochranu osobn\u00fdch \u00fadajov, napriek viac ako 4 rokom na jeho pr\u00edpravu. Na Slovensku st\u00e1le neexistuje ust\u00e1len\u00fd postup, v\u00a0r\u00e1mci ktor\u00e9ho by legislat\u00edvci hodnotili dopady legislat\u00edvy na z\u00e1kladn\u00e9 pr\u00e1va a\u00a0slobody fyzick\u00fdch os\u00f4b pri sprac\u00favan\u00ed osobn\u00fdch \u00fadajov. Postup, ktor\u00fd odpor\u00fa\u010da na pos\u00fadenie vplyvu samotn\u00fd \u00darad, je pod\u013ea advok\u00e1ta Berthotyho nepou\u017eite\u013en\u00fd na legislat\u00edvny proces: <\/span><i><span style=\"font-weight: 400;\">\u201eVyhl\u00e1\u0161ka 158\/2018 sa ned\u00e1 pou\u017ei\u0165 v\u00a0legislat\u00edvnom procese z\u00a0jednoduch\u00e9ho d\u00f4vodu. P\u00edsal ju toti\u017e niekto, kto nevie ako m\u00e1 pos\u00fadenie vplyvu vyzera\u0165. M\u00e1 \u00eds\u0165 o\u00a0\u013eudsko-pr\u00e1vnu dopadov\u00fa anal\u00fdzu; sta\u010d\u00ed sa pozrie\u0165 ako vyzeraj\u00fa zverejnen\u00e9 pos\u00fadenia vplyvu vl\u00e1dnych in\u0161tit\u00facii v\u00a0zahrani\u010d\u00ed. Nem\u00e1 to ni\u010d spolo\u010dn\u00e9 s\u00a0obsahom tejto vyhl\u00e1\u0161ky, ktor\u00e1 sa navy\u0161e ani neaplikuje na re\u017eim GDPR.\u201c\u00a0\u00a0<\/span><\/i><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Absencia pr\u00e1vnych z\u00e1stupcov pri kontrol\u00e1ch zo strany \u00daradu<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">V\u00e4\u010d\u0161ina z\u00a0rozhodnut\u00ed, ktor\u00e9 \u00darad vydal v\u00a0roku 2020, sa t\u00fdka sprac\u00favania osobn\u00fdch \u00fadajov v\u00a0re\u017eime pod\u013ea GDPR po 25. m\u00e1ji 2018. <\/span><b>Naj\u010dastej\u0161ie pokutovan\u00e9 subjekty zo strany \u00daradu boli v\u00a0uplynulom roku mest\u00e1 a\u00a0obce<\/b><span style=\"font-weight: 400;\">, pri\u010dom najvy\u0161\u0161ia zn\u00e1ma pokuta udelen\u00e1 mestu bola vo v\u00fd\u0161ke 10,000 eur a\u00a0t\u00fdkala sa informa\u010dn\u00fdch povinnost\u00ed pri obecnom kamerovom syst\u00e9me (e\u0161te v\u00a0roku 2019). Naj\u010dastej\u0161ie poru\u0161enia zo strany miest a\u00a0obc\u00ed v\u00a0roku 2020 sa t\u00fdkali problematick\u00e9ho zverejnenia osobn\u00fdch \u00fadajov, \u010di u\u017e v r\u00e1mci povinne zverej\u0148ovan\u00fdch zml\u00fav, obecn\u00fdch magaz\u00ednov alebo informa\u010dn\u00fdch port\u00e1lov a n\u00e1steniek. Obce \u010dastokr\u00e1t nespr\u00e1vne zverej\u0148uj\u00fa inform\u00e1cie o jubilantoch, naroden\u00fdch de\u0165och alebo zosnul\u00fdch osob\u00e1ch. GDPR zverej\u0148ovanie t\u00fdchto inform\u00e1ci\u00ed explicitne nezakazuje, no obce m\u00e1vaj\u00fa probl\u00e9m zabezpe\u010di\u0165 s\u00falad s\u00a0platnou legislat\u00edvou. <\/span><b>Okrem obc\u00ed boli pokutovan\u00e9 aj obchodn\u00e9 re\u0165azce, finan\u010dn\u00fd sprostredkovate\u013e, dopravn\u00fd podnik, <\/b><span style=\"font-weight: 400;\">ale aj \u010fal\u0161ie subjekty. <\/span><i><span style=\"font-weight: 400;\">\u201eZ rozhodnut\u00ed \u00daradu vypl\u00fdva, \u017ee <\/span><\/i><b><i>mnoho prev\u00e1dzkovate\u013eov nevyu\u017e\u00edva pri kontrol\u00e1ch a konaniach o ochrane osobn\u00fdch \u00fadajov pr\u00e1vnych z\u00e1stupcov<\/i><\/b><i><span style=\"font-weight: 400;\">. Vo viacer\u00fdch pr\u00edpadoch absentovala kvalitn\u00e1 pr\u00e1vna argument\u00e1cia, ktor\u00e1 by s\u0165a\u017eila \u00daradu prijatie rozhodnutia,\u201c<\/span><\/i><span style=\"font-weight: 400;\"> kon\u0161tatujte advok\u00e1t Jakub Berthoty z\u00a0DAGITAL Legal.\u00a0\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Vyzdvihnutie pr\u00e1ce s\u00fadov\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Spr\u00e1va v\u0161ak hodnot\u00ed pozit\u00edvne rozhodovaciu prax slovensk\u00fdch s\u00fadov. <\/span><i><span style=\"font-weight: 400;\">\u201eNa rozdiel od \u00daradu si s\u00fady nevedia vybra\u0165 agendu t\u00fdm, \u017ee za\u010dn\u00fa konanie z vlastnej iniciat\u00edvy. <\/span><\/i><b><i>Judikat\u00fara v tejto oblasti trp\u00ed t\u00fdm, \u017ee je m\u00e1lo \u017ealobcov.<\/i><\/b><i><span style=\"font-weight: 400;\"> Av\u0161ak, <\/span><\/i><b><i>v rozhodovacej praxi s\u00fadov neexistuje v\u00fdslovne nespr\u00e1vne, kontroverzn\u00e9 alebo nie\u010d\u00edm vy\u010dnievaj\u00face rozhodnutie v oblasti ochrany osobn\u00fdch \u00fadajov.<\/i><\/b><i><span style=\"font-weight: 400;\"> Naopak, bada\u0165 stopy po ust\u00e1len\u00ed judikat\u00fary v opakuj\u00facich sa veciach, ako je stret s info-z\u00e1konom.
